The main findings were that there are influences of the theories of F. W. Taylor and George Ritzer and was concluded that upon observation of the activities in McDonalds, there are evident uses of scientific management used in McDonalds restaurants, and that this does have a kn ock-on effect on the motivation of staff there. The recommendations of this report are that the managers need to engage the staff and try to ‘revamp’ the processes that they have in place, and give them a more direct motivation as to the rewards that they receive. 1. 0 – Terms of Reference This report is has been requested by the Senior Executive of McDonalds in September 2010, in response to a claim made by Wilson (2010). Wilson suggests that there are close links between the scientific management principles and the strict routines and procedures found in McDonald’s fast food restaurants. This report will look into scientific management principles and to see if they do actually have an effect on the management principles that are used McDonalds fast food restaurants and will briefly look at the motivation methods of McDonald’s employees, and will include observations of these methods. The basic problems found in the observation of staff, was that the observation was limited, and only observed the activities of the ‘front-line’ employees, serving the customer, and was not able to extend this to the ‘beginning’ of the process to where the food is made on the premises. This report has been compiled by an independent researcher, who will consider through observation and research whether Wilson’s suggestion does support the daily routines a customer would find when visiting such fast-food restaurants. 2. – Procedure The following procedures were undertaken in order to analyse the case study organisation. 2. 1 – Primary Research: The primary research undertaken was to observe the staff of various McDonalds restaurants, these were observed from September 2010 to December 2010 to try and obtain a more varied view of the procedures staff at McDonalds use. This is found under section 3. 4 – Individual Investigation. 2. 2 – Secondary Research: The secondary research undertaken was through websites, books and online articles. This research was used for the use of theorists used in the Findings section of the report. | 3. 0 – Findings 3. 1 Scientific management is a theory that was initially developed by Fredrick Winslow Taylor and this theory was published in 1911. In his publication, ‘The Principles of Scientific Management’, Taylor addresses the â€Å"importance of the larger question of increasing our national efficiency’ (Taylor, 1911). His theory sets out to ‘Prove that the best management is a true science, resting upon clearly defined laws, rules and principles as a foundation’ (Taylor, 1911). Taylor believed that workmen would do as little work as possible, and would produce one-third to one-half of their ability, and believed that this was universal, yet he wanted to counter this and increase the productivity of workers. Taylor suggests through his own research that many jobs, including skilled professions can be broken down into smaller tasks, meaning the less need for skilled craftsmen to complete jobs, and make their own decisions. He conducted this research in the steel industry with Time Studies; he observed worker’s sequence of motions to determine the best way for jobs to be performed. The drawbacks of this method, although it does increase productivity, are that it de-humanises the job role, and doesn’t allow for any thought of the worker to be involved. 3. 2 The four main principles of Taylor, also known as Taylorisms, are: 1. Replace ‘rule of thumb’ work methods with methods based on a scientific study of the tasks. 2. To scientifically select, train and develop each worker rather than leaving the workers to train themselves. 3. To co-operate with workers to ensure that the scientific developed methods are being followed. . To divide work nearly equally between management and workers, so managers apply the scientific management principles to planning and the work, and the worker to actually perform the tasks. (www. netmba. com) These principles were adopted mainly in factories and industrial settings, including Henry Ford’s car production factories. 3. 3 McDonaldization is a term that was created by George Ritzer based on the findings of Max Weber’s theories of bureaucracy, in his publication ‘The McDonaldization of Society’ (1995). George Ritzer explains that the fast food restaurant is an extreme example of rationalization process, where the main focus is that of efficiency and predictability. Ritzer’s four main principles of McDonaldization are: 1. Efficiency – The fastest method of completing a task. 2. Calculability – In terms of McDonald’s customers, this means to serve the customers a large amount of food in a short period of time, in terms of McDonalds staff, it is the quantity of work they do and not the quality in that they do it. 3. Predictability – Meaning whatever McDonalds restaurant a customer will go to, they would know what to expect, this applies to the product and the service that they receive. 4. Control – This is the control over the employees, everything is standardized and wherever possible, human interaction is replaced by technology. 3. 4 Individual Investigation- On conducting an investigation into what a customer would experience upon visiting McDonald’s restaurants, it was found that the experience does support the views of Ritzer, and Taylor’s scientific management principles can be applied. On being served, a customer is asked the same routine question, and the customers answer will be, again, another script-written question, i. e. What drink would you like with that, would you like to have a large meal? The employee that is serving will then either collect the order that the customer has placed, or there will be another member of staff there to carry out that particular task, so that the person ‘stationed’ at the till can go on to serve the next customer, whichever may be more efficient, with tasks being broken down. This experience alone can cover three of the four principles used by Ritzer, quite clearly; efficiency, fastest method of completing the task, calculability, serving customers with large amounts of food in a short time and also the quantity of work that they do. The third principle of Ritzer is supported by visiting a few various McDonalds restaurants, the customer will know what to expect, as stated earlier with the ‘script-written’ questions upon ordering food, to knowing the McDonald’s ‘menu’ and what you will get. The fourth principle of Ritzer’s, control, from going to McDonalds has been perceived from this observation that the managers will control the staff, ensuring that tasks are carried out correctly, as when observing the activity behind the counter, there is always a manager present, constantly going back and fourth between points, and ‘checking over employees shoulders’. 3. 5 Motivation – To look at the benefits that may motivate a McDonald’s employee, it has been researched on what promote the vacancies that are available in McDonalds. From accessing the McDonald’s website www. mcdonalds. co. k, the company advertises that the vacancies are not just short-term jobs, but the opportunity offers great training and development schemes from apprenticeships to foundation degrees, yet, they do not move away from the actual realization of the job. A very brief breakdown of a crew-members role is stated as, customer service – expected to provide customers with a quick and accurate service. The website also promotes the ‘rewards and benefits’ of being a McDonalds employee, these are; 28 days paid holidays, free private healthcare (after three years service), stakeholder pension scheme, an employee is able to exchange ? 10 directly from their pay to childcare vouchers, saving on National Insurance and Tax, and also appealing to possibly single parents, and also discount cards for large retailers, including HMV and Marks & Spenser’s. However, although all these rewards and benefits may seem appealing, there is also a short video clip on the website, titled ‘Think Again’. This is a short video, where a McDonalds employee has approached people ‘off the street’ to ask their views on people who work in McDonalds. Some answers given are that McDonalds employees are uneducated, people ‘filling in between real jobs’ and that a job at McDonalds is a last resort, however, the employee who was conducting the short ‘interviews’ was a university student, currently studying law, when this was told to the people who she was talking with, mostly all of them looked surprised, and afraid that they had offended her, but it further backed her point, of ‘think again’, not all McDonalds staff are what they appear to be, and the majority of them are studying in university for degrees. This video is a realistic view of what McDonald’s staff are considered to be, and McDonalds have tried to turn this in their favour, yet, it will be off-putting for some to apply for these jobs, and from visiting McDonald’s restaurants, the staff do not seem entirely enthusiastic and motivated, and seem to find it a struggle to offer ‘service with a smile’. 4. 0 Conclusion In conclusion, Wilson’s suggestion is a true statement of the management techniques and working procedures that are used in McDonalds. From researching the scientific management principles, and observing the activity in McDonalds, it can be seen that these principles do apply; the tasks are broken down into small tasks, to enable efficiency. All staff are trained on the job role that they are doing, and are trained to the method that fits best with the structure of the restaurant and environment that they will be working in, and managers are constantly overseeing what the employees are doing. The findings have also shown that Ritzer’s views of McDonaldization are again, quite true, and again from observation of staff working at McDonald’s, have fitted with the principles that Ritzer claim McDonald’s function on. 5. 0 Recommendations The recommendations that are found from the findings of this report are that there needs to be a more direct motivation for the staff at McDonalds. As said under the findings, the staff seem to lack an enthusiasm for the job that they are doing, even though the training and development opportunities and the rewards available are quite impressive. However, this lack of ‘awareness’ may be to the mundane and repetitive processes that the organisation have in place, and if so, McDonald’s managers need to look at this again. The students were supposed to come to school to learn, but instead they were texting. I was one of those students. I did not pay attention in class and my grades began to drop. Finally my parents took my cell phone away, and my grades started to go up; from personal experience, I know cell phones should be banned in high school. Cell phones distraction in class.Student would be texting each other or playing with their cell phone instead of listening and paying attention to the teacher. Mobile phones can cause a distraction. They can disturb teachers and students. For example, if I was working hard on a piece of work, trying to concentrating, a nd a student’s phone rings, it disrupts the whole class. I may become side-tracked or the teacher may be interrupted during speaking to the class. Teaching would be constantly disrupted if this kept happening.Education standards would deteriorate. Looking then at long term effects, if this was happening every day, you would be wasting five minutes a day, so nearly half an hour a week, and so that would be over ten hours a year of disruption. Also, mobile phones provide a large temptation to cheat in tests. They can communicate to almost anywhere and anyone in the world. Because they are small, students can quietly and discreetly send a text and it can go unnoticed. You got to school to learn, not to waste time playing games or cheating in tests.

George Orwell Essay

George Orwell’s â€Å"How the Poor Die†, is an anecdote that reflects his stay in a hospital in Paris, back in 1929. In deep detail, Orwell described the setting, people, and what he felt towards the negative atmosphere to convince readers about the horrifying Hopital X. In this essay, Orwell’s use of literary and historical reference, language use and imagery, and comparison will be discussed in terms of whether or not this essay is effective for modern readers.In his anecdote, Orwell used a lot of literary and historical references that are useful in explaining the current period that he was in. â€Å"How the Poor Die† is set in Paris, back in February 1929. He also explained to readers â€Å"’cupping’, a treatment which you can read about in old medical text-books but which till then I had vaguely thought of s one of those things they do to horses. â€Å" (Paragraph 2 lines 14-16). Elaborating the meaning of this treatment is effective for modern readers because even then, he also mentioned that readers should ‘read about (cupping) in old medical text-books’. With that explanation, modern or non-modern readers get to ha ve the idea of the unfamiliar treatment that the doctors gave him. Other than that, by telling that it is actually ‘one of those things they do to horses’, Orwell is telling readers that again, this is one of the oddness of Hopital X.It is a technique that Orwell used to convince readers that his experience at Hopital X is undoubtedly miserable. Orwell also manages to convince readers about his miserable experience by comparing Hopital X to hospitals in England. He compared Hopital X to hospitals in England because he happens to have an English blood. Therefore, the comparisons are mainly biased to English hospitals, and hence, more negativity of the French hospital is revealed. The main comparison that Orwell referred to would be the service given from the hospitals.The nurses at the Hopital X â€Å"still had a tinge of Mrs. Gamp† (paragraph 5 line 12), which is the complete opposite from English nurses. Mrs. Gamp is another historical reference that Orwell made . Based on the footnote, Mrs. Gamp is introduced as â€Å"an alcoholic who works as a monthly nurse† (paragraph 19 line 2). Therefore, we can assume that a majority of nurses from Hopital X are like her or in other words, fails to give a good service to their patients. The global economy experienced a sharp downturn in 2001 and this lasted will into 2003. Equity prices had fallen and this combined with concerns of oil supplies had created an atmosphere of uncertainty. Sales of automobiles had declined in almost all the markets. BMW was listed 6th in the largest manufactures list and had a sold 1. 12 million vehicles in 2003 with sales of 41. 52 billion Euros while General Motors which stood first had sold 8. 5 million vehicles and had sales of 157. 19 billion Euros (p. 735). All the manufacturers made good quality cars that had less than 53 defects per 100 vehicles and clearly the cars lacked unique differentiators and customers had little way of knowing which was what. Clearly only cars that had very good designs and looks were favoured. All the companies wanted to reduce costs and a few companies had shifted the base to China and India. BMW with its reputation for excellent German engineering and good designs had a slight edge (p 735). Suppliers The suppliers of the industry included the hundreds of vendors, job workshops, parts suppliers and so on. They did not have much of an advantage or bargaining power since the car manufacturers were themselves in trouble and they could easily switch suppliers if a need arose (p. 736). Potential Entrants The treat of potential entrants was not very strong as new manufacturers could not scale to the global level quickly. But companies such as Toyota had created a strong brand awareness for quality, fuel economy and service and cars made by Toyota had become increasingly popular, at least in the mid class of cars. Potential entrants would have to devote enough resources for the engineering and then again spend on advertisements and companies were spending up to 50 billion USD on advertising and marketing and this worked to $ 2, 900 for each car sold. BMW had already created an image for excellent quality cars that were powerful, had good design and also very less problems (p. 737). Buyers It was a totally buyers market and there were hundreds of varieties of cars made by leading manufacturers and they could demand excellent quality. Moral Theory and Personal Relationships :: Michael Stocker Ethical Theories Essays

Moral Theory and Personal Relationships In his article "The Schizophrenia of Modern Ethical Theories," Michael Stocker argues that mainstream ethical theories, namely consequentialism and deontology, are incompatible with maintaining personal relations of love, friendship, and fellow feeling because they both overemphasise the role of duty, obligation, and rightness, and ignore the role of motivation in morality. Stocker states that the great goods of life, i.e. love, friendship, etc., essentially contain certain motives and preclude others, such as those demanded by mainstream ethics.11 In his paper "Alienation, Consequentialism, and the Demands of Morality," Peter Railton argues that a particular version of consequentialism, namely sophisticated consequentialism, is not incompatible with love, affection and acting for the sake of others. In the essays "War and Massacre" and "Autonomy and Deontology," Thomas Nagel holds that a theory of absolutism, i.e. deontology, may be compatible with maintaining personal commitme nts. The first objective of this paper is to demonstrate that despite the efforts of both Railton and Nagel, consequentialism and deontology do not in fact incorporate personal relations into morality in a satisfactory way. This essay shows that Stocker’s challenge may also hold against versions of Virtue Ethics, such as that put forth by Rosalind Hursthouse in her article "Virtue Theory and Abortion." The second objective of this discussion is to examine criticisms of Stocker made by Kurt Baier in his article "Radical Virtue Ethics." This essay demonstrates that in the end Baier’s objections are not convincing. Stocker begins his paper by arguing that modern ethical theories fail because, by and large, they deal only with the reasons and justifications for people’s actions and ignore people’s motivations. This failure to address the role of motivation has led to a form of schizophrenia in an important area of value;22 people are unable to reconcile their motives with the moral justifications for their actions. Stocker highlights the constraints that motives impose on both ethical theory and the ethical life in order to show that only when justifications and motives are in harmony can people lead the good life. Stocker believes that mainstream ethical theories, like consequentialism and deontology, make it impossible for people to reconcile their reasons and motives because these theories demand that people perform acts for the sake of duty or for the good, as opposed to because they care about the people who are affected by their actions.

A Sense of Place in Austen's Pride and Prejudice It is interesting to observe Dictionary.com's definition of the word "place" in relation to "person". Especially when it comes to Pride and Prejudice, where Austen has made great use of the objective correlative technique, in which many, if not all, of her settings considerably reflect the characteristics of their owners. She additionally employs several other techniques regarding the sense of place in her novel, which are important not only in the facilitation of numerous plot points, but also in establishing and understanding her characters and their relationships. So what are these techniques, and why are they so effective? To find the answers to such questions, we should look closely at Austen's methods of incorporating a sense of place into her novel. The technique of objective correlative is often used in establishing the qualities of a character by having them reflected in that character's surroundings. These can be material objects, belongings, or in Austen's case, locations. If we take a look at the setting of Rosings, we see that it is described as ostentatious, overwhelming, and, in comparison to Pemberley, the other grand country estate, rather garish: From the entrance hall, of which Mr. Collins pointed out, with a rapturous air, the fine proportion and finished ornaments, they followed the servants.... In spite of having been at St. James's, Sir William was so completely awed by the grandeur surrounding him, that he had but just courage enough to make a very low bow, and take his seat without saying a word; and his daughter, frightened almost out of her senses, sat on the edge of her chair, not knowing which way to look. (p. 121) S... ...m. Through usage of the objective correlative, readers can gain a great deal of insight into the characters themselves, and thus further enjoy the novel with an enhanced understanding of Austen's creations. She also establishes a sense of balance by having the more influential events of the story take place in the openness of the great outdoors, and those of less import occur within the boundaries of the inside. Additionally, Austen has her characters travel to various parts of Great Britain, which allows for correspondence in the form of letters (serving to facilitate the necessary delay of action) and for mistakes to be made. Austen has made great use of the sense of place in Pride and Prejudice, and her techniques coalesce to deepen the reader's understanding, to give a sense of balance, and to effectively enhance the enjoyment of a delightful story.

Killing the Black Body †Summary Essay

Control of reproductive decisions of black women is a highly prevalent a form of racial oppression in America. Due to this form of control, the meaning of reproductive liberty in America has been significantly altered. These issues are addressed in Dorothy Roberts’ Killing the Black Body. The novel demonstrates the way in which black women were consistently devalued as a tool for reproductive means, which in itself was a form of racial oppression. The novel also provides the reader with insight as to how experiences of black women since times of slavery have drastically changed the present day connotation of reproductive freedom. Robert argues that throughout American history, the reproductive capacity of black women has been used against them constantly as a means of racial oppression, control, and devaluation. Since the times of slavery, the institution of black motherhood has been minimized and disgraced. For instance, black women were forced to become pregnant. They faced the threat of sterilization through coercion. Black women were vigorously implanted with Norplant, denied welfare because of their procreation, and were imprisoned due to reproductive choices. Their children were taken away and sold to different slave-owners. During the times of slavery, black women were sexually exploited for reproductive reasons and in order to oppress and humiliate the black community. Roberts discusses in Killing the Black Body: After Emancipation, the Ku Klux Klan’s terror included the rape of Black women, as well as the more commonly cited lynching of Black men. White sexual violence attacked not only freed Black men’s masculinity by challenging their ability to protect Black women; it also invaded freed Black women’s dominion over their own bodies (pg. 1). This form of sexual exploitation of black women by white men intimated ulterior motives beside slave breeding. The employment of sexual exploitation of black women by white men as a weapon of fear was a method for whites to strengthen control over â€Å"human property†. Victims of rape and other forms of sexual harassment became more vulnerable and susceptible toward psychological and emotional control by whites due to severe mental and physical ramifications. Sexual harassment was a means of forcing blacks into submission; this tactic created a somewhat obedient abor force. Besides these motives, black women were denigrated through use of their reproductive capacity as a form of slave breeding. During the times of slavery, black women were forcefully impregnated both in order to maintain the institution of slavery and as an economic incentive for white slave owners to control the reproductive lives of black women. A black woman’s child was considered the property of her slave owner from the moment of conception. This key feature in the institution of slavery gave whites the ultimate power of repression against blacks in America. Despite this fact, black women fought back. They took initiatives such as self-induced miscarriage in order to not bear a child. Unfortunately, these women were punished for taking such initiatives; however, they were reprimanded for the wrong reasons. As Robert demonstrates: Indictment further alleged that on December 11, so â€Å"that she might more speedily kill and murder said Angeline,† she wrapped the baby in bedclothes and then â€Å"choked, suffocated and smothered† her. Historian and former federal judge A. Leon Higginbotham, Jr. , asks two important questions about this case. First, he questions Missouri’s purpose in convicting Jane for murder: Did the state prosecute because it cared about the dignity and life of a child born into lifetime slavery with the concomitant disadvantages of Missouri’s law? Or did the state prosecute because Jane’s master was denied the profit that he would have someday earned from the sale or exploitation of Angeline? pg. 49). This illustrates that white men devalued black women by not only using them as a source of reproductive means but also by dehumanizing their black children as the courts convicted these mothers in order to protect whites’ financial stake in the children, but not out of respect for the children themselves. Hence, black women were an economic resource for whites, utilized for sustaining slavery and significantly devalued as well as objectified. Salters (2013) states in her article a recent event where a doctor was accused of illegally videotaping and photographing over hundreds of patients – mostly women of color – during their medical procedures in John Hopkins’ East Baltimore Medical Center, which serves low-income African-American women. This scenario is an ultimate example of the continuation of a long history of dehumanization as well as objectification of Black women as their nude and vulnerable bodies were recorded without their consent. Robert further argues for an idea of reproductive liberty that identifies race as an important reproductive rights issue. She states that the experiences of Black women since slavery has shaped the present day interpretation of reproductive freedom. Robert’s book, along with the content we have discussed in class, has given me a more eye-opening understanding of the racism that still exists in America currently. A concept that reoccurs today since slavery is the idea that whites have defined the notion of woman and fetus. A Black women’s main value as a slave was to produce offspring, which is producing more slaves for the whites. If the pregnant slaves fought or rebelled against the demands of their owners, they were punished without harming the economically profitable fetus inside the slave. Robert notifies: Williams recounted the beating of pregnant slave women on a Mississippi cotton plantation: â€Å"I[‘]s seen nigger women dat was fixin’ to be confined do somethin’ de white folks didn’t like. Dey [the white folks] would dig a hole in de ground just big ‘nuff fo’ her stomach, make her lie face down an whip her on de back to keep from hurtin’ de child (pg. 31). From the start, these form of acts performed by the white owners marked Black women as objects whose decisions about reproduction were subjected to social regulation rather than to their own will. Furthermore, by punishing these pregnant slaves, whites’ implied the message to these women that they were nowhere nearly as valuable as the unborn child that they were carrying. This concept demonstrates the existence of racism in today’s society as it is repeated through accounts of Black women being forced into cesarean sections, prenatal care and other medical treatment â€Å"for the good of the fetus,† because the women are considered too selfish or illiterate to choose for themselves. This is also witnessed when pregnant Black woman are imprisoned for smoking crack and only cases regarding crack smokers are aimed at due to racist intentions, while ignoring the utilization of other drugs. These women have their babies taken away from their care and forced into crowded foster homes. They are often sent to jail while pregnant â€Å"for the betterment of the fetus† and are forcefully implanted with Norplant as a condition of probation, regardless of all the complications that come with carrying on such an implant. Moreover, welfare is seen as only for white women and Black women were to blame for having children they knew they could not afford to raise. Women of color are consistently punished for their decisions regarding procreation even today, as charges are dropped if these women, who smoked cracked during pregnancy decided to abort.

1. Propose an organizational structure for the IT department that you feel would support the transformation of AgCredit into a process-centric organization. Recognition of business ownership will be vital to the organizational structure. Having the business sign on and join the conversation about IT and related projects will be instrumental. A steering committee will be need to be part of the approval process of all projects is needed to make sure an enterprise view is taken. The multidivisional committee will need to ensure all projects fit within a SOA framework. The CIO should be involved in the boardroom and have access to senior management, including the CEO. The CIO should hire senior management that can convey departmental and business objects and help guide IT employees. Account managers for each LOB that reside in the business but report to senior IT management should be installed. The entire IT staff will need to be reassessed to ensure the proper people are in the right job roles. The IT function will need to be brought in alignment with the enterprise vision. One option is to try to promote internally for vacant IT positions and insource the roles that cannot be filled. Insourcing will have the distinct advantage of training IT personnel while getting the job done as well. Outsourcing IT functions that are not core competencies can also be employed if desired. AgCredit should appoint a CEO who is responsible for carrying out the strategic plan and will ultimately responsible for managing company operations coupled with a Vice President would oversee operations, carry out the strategic plan set forth by the CEO, and manage the four separate divisions. The CIO would direct the IT department, which would include several IT senior leaders, as well as guide the company’s technological direction. The CFO would be largely involved with both the business and IT departments, helping to give a deeper understanding of cost components and act as an advisor to both IT and business regarding legacy software and future projects. A business analyst would be the link between the IT and business departments, matching technology to business needs, and predicting future business directions. The IT relationship manager would be the connection between the business and IT departments and would ensure the IT governance is translated into business terms. Other staff could include an applications architect who would design applications, implement middleware and infrastructure; and a Network manager who would direct daily IT operations, test, deploy, and integrate network systems. A steering committee will be needed to be implemented as part of the approval process of all projects. 2. Outline a project selection process for AgCredit to ensure alignment with the enterprise business vision. As mentioned in the last question, a steering committee that represents many LOBs will need to be formed and giving decision making capabilities. Next the committee members should outline how the project effects their division and could be used to meet departmental needs if possible. Additionally it will need to make sure it fits within the SOA and is not duplicated by other software nodes or current processes. Making sure it can be modularized and standardized for the business will be vital for the organization’s architecture. Manley will need to present the key strengths of SOA and make sure to focus on how it will support the company’s vision and goals. The transition will simplify the organization and speed up product implementation. Current services and products will be available or modified for usability. It supports web services that align with continuous growth opportunities, expanded customer relationships, and ability to cross-sell between the divisions. It will immediately offer up opportunities for the divisions both in terms of possible financial gains and stretching development dollars. Existing services can be purchased and implemented quickly within the SOA. This increases our capabilities and ensures we stay  caught up with the larger firms. In essence this can level the playing field providing valuable resources and systems. Once the customer information is centralized, which is required for SOA, the savings from reducing database needs will be realized. Having common processes will align the business as a whole and ensure value from increased communication and decreased uncertainty. This kind of technology base may allow the way we work to change, for example working from home or on the road working through a VPN. 4.What new internal IT capabilities will have to be developed in order to create an IT department to support AgCredit’s future business architecture? The capabilities needed to support the SOA from the IT perspective are management tools, information management tools, Information delivery options, development cycles, and a customer service attitude toward the divisions. Role clarification will be important in setting up these capabilities. Management tools include visioning and business alignment processes, funding methods, measurement metrics and focus, and monitoring methods. Information management tools include collection activities, organize process including schemes and taxonomy, process modules to use the information, and maintenance procedures that support business functions. Development cycles must conform to SOA standards and guidelines, using compliant hardware and software to make systems that breakdown the functionality, and complaint with regulatory needs, including system proficiency in creating reports for audit purposes. The customer service attitude will be needed to manage perceptions and keep close ties with the business. 5.What aspects of IT governance do you think would be important in supporting this transformation? Before governance structures are formalized the enterprise and divisional vision and objectives should be outlined. With IT working alongside the business some guiding principles must be drafted up. This may involve setting up account managers within the LOB and forming a multidiscipline steering committee with considerable decision power. This steering committee should work closely with the CIO and have high level approval and corporate sponsorship. The governance system should focus on  guiding the transformation process and keeping key issues in focus, such as sox and regulatory compliance. Stakeholder involvement in the steering committee will help the business and IT structures become partners and work together. It will ensure all voices are heard and considered in the decision making process. They should outline policy decisions that support the organization’s vision earl y on.

Color of Law Essay

As a Legal Management Student who will soon be proceeding to Law, I have learn and realized so many things about being a lawyer when I finished reading the Color of Law by Mark Gimenez. When I was still a little child my dream was to become best lawyer so I can help those unfortunate people. I always thought being a lawyer is about helping, defending, and giving justice to my fellow Filipinos. I also thought that when I become a lawyer I can have lots of money to provide my needs and as to my family. I also thought that those lawyers were the best because they gamble their lives every day just to defend the citizens of its country. Then I have realized that it is just all in my imagination because in the real world lawyers do not usually do everything right, sometimes it is all lies in my eyes. â€Å"Scotty, the color of law isn’t black-and-white, it’s green! The rule of law is money—money rules! Money makes the law and the law protects the money! And lawyers protect the people with money!† –Dan Ford With this line it made me realize that for some lawyers they do not put their hearts in protecting the law but their ambition and love for money. It also made me realize that the codes and rules made in black-and-white does not already governs the law and the people but it is the money that makes the world go round. I have also realized that some lawyer’s cheat under the law, they do not even care about giving justice to the unfortunate or to the innocent but they make the wrong right in the eyes of others. Lastly, I have realized that when money is involved justice is not followed by its right purpose. But what I have learned from this statement is that when I become a lawyer in the future I should fight for the right thing and not blind myself with the wrong one for money. I have also learned that we are the future generations and we should not be poisoned by what is happening now but rather should make a change for the better of the society. In the story I have seen that Scott and his other colleague’s works in a best and the most famous Law Firm. I have just realized that they are working in a best and the most famous Law Firm is because they have worked hard in attaining their college degree. I have also realized that they are highly paid by the firm because they belong to the top students of the best university in Dallas. So I have learn that if I want to be employed by the most famous law firm in the Philippines, I have to work hard to be one of the best students in my future law school. I have also learned that for me to be highly paid by my employer in the future I must be one of the bar top-notcher. Though I do not promise to be this in the future but it made me realized that trying can always be the best solution. Third, I have seen in the story that when Scott was appointed to be the lawyer of Shawanda who is a prostitute and a drug addict that he did not truly believe that she is innocent. I have realized that most of the best lawyers are not usually the best when it comes to their jobs as a lawyer because a lawyer must not judge their clients but must always put their clients to be innocent. I have learn that when a lawyer what to prove her client innocent, he must first have faith and belief of her client’s innocence from the crime. It is important because when you as her lawyer do not believe that she is innocent then she might lose her confidence and instead force to tell a lie and may commit a greater mistake. Fourth, I have also seen in the story that when Scott was about to lose everything, he did not care or think about his family or what could happen to his family. Although Scott was just being kind, he just cared for his client and even doing the right thing but for me family is the most important thing in the world. I would not want to give up everything just for my clients but instead I would fight all these circumstances just to defend my family from all of these. I have realized with this that there is no purpose of winning a case if you do not have a real and complete family to celebrate with. I have learned from this that when I become a lawyer in the future I would do everything to defend my client and do the right thing but in a right way. Fifth, I have realized from the story that they portrait or described lawyers as cheaters, dishonest, and immoral. I think that this is not a good example to those young aspiring lawyers to be. I have learned that as of today being a student aspiring to be a lawyer in the future, I would do my best to practice law in a lawful and in a moral way. I would also start to respect the law by putting God first so I would be guided on what is best way to solve without being a distraction to the society. I think that if lawyers do the right thing with good and moral intention then we could have a peaceful society and justice would be given fairly. I have learned that being a lawyer with good moral character is what a lawyer should be proud of and not the multiple numbers of cases he had won because at the end of the day people do not usually care about you but you instead could make yourself proud of what you did. I have seen that Scott did not totally believe in God’s grace on how he would handle with his life. I believe that God is the center of everything so we must put him first in everything that we do. I believe that with every profession when you just trust God, he would help you be the most successful person. I have seen from Scott’s situation that he did not trust God or pray for Shawanda’s life to be reformed but instead he judged her until the end. I have learned from it and I promised myself that when I become a lawyer I would definitely put and trust God first in every case that I would encounter. With this inspiration I would be able to abide and follow the law in a right way. â€Å"VOIR DIRE † is a legal phrase meaning â€Å"to speak the truth.† I really think that these words are the most important thing to be remembered in practicing the law. I have learned from the book that being a lawyer you must first put in mind or practice to speak the truth because as a lawyer you stand to be the leader of the law. I also think that if you speak the truth then the truth would prevail. Also speaking for the truth is a way of respecting the rules of the law and yourself. I also think that if you have this within you then you will also be spoken by the truth by others. I learned that in a court trial people do not usually want to hear the truth and just cared about winning the case but when one speaks of the truth then we would have a peace of mind, heart and a clean conscience. I believe that professors should not only teach about the subject matter but must educate their students to be a lawyer who has dignity to stand for the truth. I also believe that a parent should teach and practice their children to tell the truth because they might turn out to be lawyers in the far future. I am thankful that we were tasked to read this book because it made me realized so much about how lawyers act and deal with different cases that they had encountered. I have now learned how they worked, how they find and gather those evidences about the complainant without complicating things. I have also learned how a case works on a real court, how suspects and the witness is asked about the case. I now know how the lawyers asked each witness facts out of the blue and find out the real suspect. And because of this book I have now learn so much on how to be a better lawyer and not follow the footsteps of those lawyers who are deceitful and dishonest. Now I know how to deal with suspects that are involved in criminal cases by respecting and not judging them with what other people think of them. I have realized that I should be different to make a mark and be known to people and my clients in the future by my good moral character. I have also learned that when I become a lawyer, I would not do something deceitful, fraudulent or immoral just to win a case and make a lot of money but I would do the right thing even though I won’t be remembered from it. After reading the book I have fully made up my mind that I would be taking up law school. I promised myself to study well and make my parents proud of me. I think the book stand as an inspiration to me to become a best and better lawyer than those describe by the book. I want to be different from them because I see their life unhappy and not contented with what they have. I hate how the lawyers wanted to be the best and even more, I think it is childish because when you’re a lawyer you should be proud of what you’re capable of and make the most out of it or you should learn from every mistake you take and be better. But despite the wrong this Scott Fenney had done in the past, I still idolized him and wanted to be liked him in the future because it taught me that his intelligence got him to his dreams. Also I idolized him because he fought for the right and defended her client even if she is known to be a prostitute and a drug addict. I idolized him for turning his mistakes and made it right by leaving his past life from being one of the rich citizens of Dallas. I also idolized him for being a responsible son to his mother because although his mother was dead, he did his best to rich his mother’s dream for him to have and reach everything they had in mind together. And lastly, I want to be liked him because although he was not a very good husband to his wife because he did not stop his wife from leaving him still he was a good and the best father to his daughter Boo. He did a great job taking care of his daughter and making her part of his career by sharing how his job works. He also inspired me because he help and let Pajamae stay at their home despite the fact that she is black and a daughter of a prostitute and a drug addict. â€Å"Brilliant lawyers without rich clients are worthless to large law firms† I think this is true because being in a large law firm you have to maintain the amount of money you contribute. Also in a law firm you have partners who trust you by bringing their firms name but of course you have to pay back. This is why you owe the firm for giving you clients because clients does not directly go and see a personal lawyer but they trust a big law firm where they can be sure not to be disappointed. Also lawyers that are less brilliant and less intelligence with rich clients are still worthless or useless because all though you will still be paid large still clients would not be satisfied by the result and does want to go back. I think that being a good lawyer is better than being a rich lawyer but you suffer with your criminal or fraudulent actions. When I become a lawyer I would first make sure and review my actions before I mixed my career with money. I believe that my reputation and my character is the best thing that I can be proud even without money. I may be poor by this belief or thinking but being a lawyer can be a great value as money is. I also believe that this will find me happiness and peace but money will only buy happiness temporarily. Being a lawyer with a good heart will be permanent to my being. I know that if I would just do what a lawyer should really do I would be blessed by my clients that can see my efforts and pay me good money. With this I know that I have worked hard for that money and not earn a lot of money for something I did not do. I want be paid by my hard worked and efforts that I had invest than being paid and never returned the worth. I have also realized that maybe someday I would enter politics and maybe become one of the senators in the Philippines but that I can sure that when such time comes I would definitely return the favor for putting me in a great position. I would stay in the position as a fair senator who will do everything for the better of the society. I would not be like Senator McCall in the story that buys everything with money and expect to cover up all the bad information’s about him. In real life when we commit mistakes we should not cover it up but instead we ask for forgiveness to those who we had hurt and learn from it. People will understand and eventually forgive you in time because we all know that nobody’s perfect and we all make mistakes. I think the book is good because it made lawyers see what a true lawyer is from lawyers who are just pretending to be the best but they really are foolish. I also like how the book portrayed and describe every detail how the characters are because we learn from their characters. Just like Rebecca who is ambitious and was just after the money that Scott can offer. She does not even make Scott feel loved because she does not allow him to touch her. I did not also liked her character because she did not appreciate how Scott worked hard just to give her what she dreamed of, from a mansion, car, dresses and a great husband who loved her so much. And lastly, her character of leaving his child and husband for a golf boy who does not have anything to offer her and she is not even sure that he really love her or just for money. She was not a good example to her daughter for how she acted in times of worst which might happen and followed by her daughter. She should have said sorry to her daughter for leaving them not saying goodbye because she is better without her, a child would not understand that. Summary Scott Fenney, a successful lawyer who knows how to bend the rules, mastering the creative skills of being a lawyer and a lawyer who makes lots of money from it. He graduated as a top student from SWU. He has a wife Rebecca and a daughter named Boo. They lived happily and peacefully at a mansion at Highland Park and he drives a Ferrari. He works at the Ford Stevens Law firm and earns half and more than a million in a year. The Ford Stevens Law firm is known to be the best law firm in the state. He is a corporate lawyer who represents corporations and never represented an individual person convicted of crime. A case was broadcast to the public news about the murder of Clark McCall who is the son of the Senator Mack McCall in Dallas, Mexico. Clark McCall was found dead in his bedroom shot above his left eye and the murder was suspected to be the prostitute Shawanda Jones who has been with him on the day he died. The case does not involve Scott and his life was perfect until Judge Buford appointed to be the lawyer of Shawanda Jones to defend her from the crime of murder. He visited Shawanda from the jail and he witness that she is a heroin addict. He asked Shawanda about the crime and what happened. Shawanda told her story to Scott that she was picked up by Clark at Harry Hines Boulevard and was promised to be paid a thousand dollars to spend a night with him. They then arrived at Clark’s placed and to his bedroom but then Clark started to slap her that she in return punched him in the eye and kicked him in the balls, that he fell to the floor and she took her thousand dollars and his car keys and drove herself back to Harry Hines and left the car there. Scott asked her why was her weapon used in the crime scene, she then explained that it might have slipped from her purse when she was in a rush from getting away. Scott then asked her why she does she carry a gun in her purse, she then answered that she lives in the project where your life may be in danger anytime. Scott did not believe at that time, he believes that when your gun is the murder weapon of the crime scene then you must have done it. Dan Ford owner of the Ford Stevens Law firm is the personal lawyer of Senator McCall and was told that he should convinced his lawyer to declined or put down the case. Dan then told Scott that it would not be good for the Law Firm’s image to engage in a case of murder because they represent known associates of a corporation. He warned Scott that it would destroy his career to represent a prostitute. Scott also did not want the job appointed to him and wanted to assign another lawyer Bobby as a substitution. Bobby is a criminal defense lawyer but is not a very successful lawyer, he even envy and is jealous of Scott’s successful career because he does earn much as his friend do. He accepted the job offered to him by Scott but when they represented to court and told the judge about the substitution, Shawanda had a choice to choose which lawyer she wants to represent her and she still chose Scott. So Scott had no choice and pursued with the case despite the allegations and warnings about his career. Shawanda is a black woman who has a daughter named Pajamae who was left at their house at the projects. Scott was asked a favour from her to check on Pajamae and to bring her in jail to see her mother. The projects is a wild place in Dallas where black people lives and where troubles usually happen. He took Pajamae to her mother in jail and he was afraid to go back, so he decided to let Pajamae stay with his family in Highland Park where he has a daughter same as her age. His wife Rebecca did not like the idea about it but his daughter Boo did want to have a sister and she got along well with Pajamae. During the months before the trial, they gathered every facts and evidence to defend or prove Shawanda innocent. They investigate Clark’s background and found out that he has a history of alcohol and drug abuse, also some allegations of rape. I was brought to court about the issue then Senator McCall got angry of what Scott turned out to be. So the next following days Scott began to lose his car which was going to be taken away by the bank he owned a loan to. Then he needs to pay his bills but he was running out of cash. He was okay with losing everything because he knows he has clients who pay him half and more millions in a year but when he went to see his client Tom Dibrell, he was shocked that Tom is firing him. He blamed everything to Senator McCall but when he went to see and ask his boss Dan Ford to tell the bank to give him more time to pay his loan but Dan refused and Scott was confused but he then eventually connect the dots that Dan was the one behind all that is happening to him. Dan asked him again to put down the case but Scott refused then he was fired from the firm which was his only resort with his life problems. After losing everything he owned, his wife Rebecca left him because she cannot longer take the humiliation and what people would think. After everything that had happen he thought to himself to do his very best to prove to the public that he is a good lawyer and he can prove that despite Shawanda’s background she is innocent. They gathered name of some girls that Clark may had rape or sexual harassment but only one of the girl responded and wanted to be a witness. Hannah Steele did not file charges and damages when the time she was raped because she was scared and blackmailed by McCall so he kept quiet for a long time. They kept her named until the final trial because she is the only solution to prove that Clark was a rapist and a racist. The month of august was about to arrive but they are still not yet ready for the trial because they got only one witness and no other evidence about Shawanda’s innocent and to prove that Clark is a rapist and a racist. They had a last resort who is Carl an assistant of Bobby where he is investigating Clark’s background to gather other witness. So Scott and Bobby had only one blast who is Hannah Steele who apparently refused to speak on the day of the trial. Then Scott did not know what to do, what to ask the witness of the other side of the case just to defend Shawanda. Then right after he was losing hope on winning the case, Carl arrived at the court and presented an envelope to Scott which has the flights from Washington to Dallas on the day Clark was murdered. The trial go on, Scott asked and listened to witnesses who are police and Fbi who were present on that day. He then realized after listening and seeing all the pictures of Clark’s murdered body that Shawanda was left-handed and that Clark was shot on the upper part of his right eye. So Scott made a realization that the murderer was a right-handed which is not Shawanda. So he gathered and reviewed all the flight documents from that day and found Clark’s flight and a related person to him was on a flight just next to his scheduled flight. The person related to him on the next flight with the same destination as him was Delroy Lund who is a bodyguard of his father Senator McCall. When Delroy was asked on court about his presence on the day Clark died he said he was in Washington with the Senator. Then when Scott presented the documents and asked him why was his name registered with his driver’s license number, he answered and made an alibi that he forgot about that day. Then he accidentally denied killing Clark but called him something foolish and the court suspected that he is the murderer. The court suspected and found him guilty of killing Clark because he really has hatred and jealousy from Clark and he followed him that day because she suspected that Clark was going to do something foolish again.
